This Privacy Policy explains how Briggs Consulting, LLC ("Company," "we," "us," or "our") collects, uses, discloses, and retains personal information when you visit our website, create an account, purchase or use our products or services, take assessments or quizzes, use AI-powered tools, enroll in courses or memberships, apply for coaching, communicate with us, or otherwise interact with us.

This Privacy Policy is intended to comply with applicable U.S. privacy laws, including California privacy requirements where applicable. If a law grants you rights that cannot be waived, nothing in this Privacy Policy limits those rights.

1. Scope and Important Limitations

Our Services are intended for adults only and are not intended for individuals under 18. We do not knowingly collect personal information from children under 18.

Our assessments, coaching-related materials, quizzes, courses, and AI tools are provided for educational, developmental, and informational purposes. We do not intentionally collect medical, mental health, government identification, precise geolocation, or other sensitive personal information unless we expressly request it for a lawful purpose and provide any legally required notice.

2. Categories of Personal Information We Collect

Depending on how you interact with us, we may collect the following categories of personal information:

3. Personal Information We Do Not Intentionally Collect

We do not intentionally collect precise geolocation, government identification numbers, health or mental health information, or sensitive personal information as defined by California law. Users should not submit sensitive personal information through assessments, coaching applications, AI tools, contact forms, or other Services unless specifically requested and appropriate safeguards are provided.

4. How We Use Personal Information

We use personal information for the following purposes:

  • Provide, maintain, personalize, and improve the website and Services;
  • Create and manage user accounts, memberships, subscriptions, and course access;
  • Deliver assessment results, quiz results, digital downloads, courses, emails, newsletters, and coaching-related communications;
  • Process payments, receipts, subscriptions, renewals, cancellations, refunds if legally required, and tax or accounting records;
  • Operate AI-powered tools and generate outputs based on user inputs;
  • Provide customer support and respond to inquiries;
  • Send transactional, service-related, renewal, cancellation, marketing, and newsletter communications where permitted;
  • Prepare aggregated or anonymized team reports for entity products;
  • Protect the security and integrity of the website and Services, prevent fraud, and enforce legal rights;
  • Comply with applicable laws, court orders, legal processes, and regulatory obligations; and
  • Use reviews, testimonials, and feedback in accordance with applicable law and permissions.

5. Third-Party Service Providers and Disclosures

We disclose personal information to service providers and contractors that help us operate our business and provide the Services. These may include:

  • Payment processing: Stripe;
  • Email marketing and transactional email: Kit and Resend;
  • Website hosting and analytics: Vercel and Vercel Analytics;
  • Privacy-focused analytics: Umami Analytics;
  • Product analytics and session replay: PostHog;
  • Advertising and conversion tracking: Google Ads;
  • Database and authentication: Supabase;
  • Scheduling: Cal.com;
  • Video conferencing and interviews: Zoom, Microsoft Teams, Google services, or similar tools;
  • AI infrastructure: OpenRouter or similar AI service providers;
  • Customer support: email and related business tools; and
  • Professional advisors, legal counsel, accountants, or compliance providers when necessary.

We may also disclose personal information when required by law, subpoena, court order, or government request; to protect our rights, users, safety, or property; to prevent fraud or abuse; or as part of a business transaction such as a merger, acquisition, sale of assets, financing, or restructuring.

6. Sale or Sharing of Personal Information

We do not sell personal information for monetary consideration. We do, however, use certain third-party advertising and analytics technologies that, under some U.S. state privacy laws (including California), may be characterized as "sharing" personal information for purposes of cross-context behavioral advertising or as the use of session replay technology. Specifically:

  • We use Google Ads conversion tracking and similar tags to measure the effectiveness of our advertising campaigns and to support remarketing audiences (showing our ads to people who have previously visited the website).
  • We use PostHog for product analytics and session replay. Session replay captures user interactions with the website — such as clicks, page navigation, and form interactions — so that we can understand and improve the user experience. Sensitive form inputs (such as passwords) and content marked as private are automatically masked from recordings, and PostHog respects Do Not Track browser signals where supported.

We do not currently use Meta Pixel, LinkedIn Insight Tag, or TikTok Pixel.

To the extent any of the technologies described above constitute a "sale" or "sharing" of personal information under applicable law, California residents and residents of other states with similar rights may opt out by contacting us at Briggsconsulting.coaching@gmail.com or, where supported, by enabling a Global Privacy Control (GPC) signal in your browser, which we honor where legally required.

If our practices change in the future, we will update this Privacy Policy and, where required by law, provide additional notice and opt-out mechanisms.

7. Cookies, Analytics, and Cookie Notice

We use cookies and similar technologies for several purposes:

  • Essential cookies support login sessions, authentication, security, account access, and core site functionality.
  • Privacy-focused analytics cookies from Vercel Analytics and Umami Analytics help us understand page views, traffic patterns, and website performance.
  • Product analytics and session replay cookies from PostHog capture user interactions so we can improve the user experience. Sensitive inputs are automatically masked, and PostHog respects Do Not Track browser signals.
  • Advertising and conversion-tracking cookies from Google Ads measure ad-campaign effectiveness and may support remarketing audiences.

The website should display a cookie notice that is clear, conspicuous, and easy to use. At minimum, the notice should state:

"We use cookies to operate our website, provide account functionality, understand site usage through analytics and session replay, and measure the effectiveness of our advertising. You can accept or decline non-essential cookies, and you can adjust your preferences at any time."

  • Buttons should include: "Accept", "Decline Non-Essential", and "Cookie Preferences" or equivalent controls.
  • The decline option should be as easy to use as the accept option.
  • The website should store the user's cookie choice, provide a way to change preferences later, and honor applicable browser-based opt-out signals (including Global Privacy Control) where required.

You may also manage cookies through your browser settings. If you block essential cookies, some website features may not work correctly.

8. Team and Entity Products

For team or entity products, the purchasing organization may receive aggregated or anonymized data, overall team scores, trends, participation information, or completion metrics. The Company does not provide individual assessment responses, individual results, personal development goals, or one-on-one coaching content to an employer or organization unless the individual has given explicit permission or another lawful basis applies.

Assessment tools are intended for leadership development and should not be used as the sole basis for hiring, promotion, discipline, compensation, termination, performance review, succession planning, or similar employment decisions.

9. AI Tools

If you use an AI-powered tool, the information you submit may be processed by the Company and applicable AI infrastructure providers to generate an output. You should not submit sensitive personal information, confidential information, trade secrets, health information, or information belonging to others unless you have authority and the tool expressly permits that use. AI-generated outputs should be independently reviewed before use.

10. Marketing Communications

We may send newsletters, product updates, service announcements, renewal notices, receipts, assessment results, course materials, and other communications. You may unsubscribe from marketing emails by using the unsubscribe link in the email or by contacting us. Even if you opt out of marketing emails, we may still send transactional or service-related messages, such as receipts, account notices, subscription notices, legal updates, or security communications.

11. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide Services, maintain accounts, comply with legal obligations, resolve disputes, enforce agreements, and maintain business records. Current retention practices include:

12. Your Privacy Rights

Depending on where you live and whether applicable legal thresholds are met, you may have the right to request access to personal information, correction of inaccurate personal information, deletion of personal information, portability of personal information, information about categories of personal information collected and disclosed, opt-out of sale or sharing, limitation of use of sensitive personal information, and non-discrimination for exercising privacy rights.

We do not sell or share personal information for cross-context behavioral advertising and do not intentionally collect sensitive personal information. If you submit a privacy request, we will evaluate and respond as required by applicable law. We will not deny a legally required privacy right based solely on company discretion.

We may request additional information to verify your identity or authority to act on behalf of another person. Authorized agents may submit requests where permitted by law, subject to verification requirements.

13. California Privacy Notice

This section applies to California residents to the extent California privacy law applies to the Company. In the preceding 12 months, we may have collected the categories of personal information listed in Section 2 above, from the sources described in Section 2, for the purposes described in Section 4, and disclosed them to the service provider categories described in Section 5.

California residents may have the right to know, access, correct, delete, obtain a portable copy of personal information, opt out of sale or sharing, limit the use of sensitive personal information where applicable, and be free from discrimination for exercising these rights. We do not sell personal information and do not share personal information for cross-context behavioral advertising.

We will honor Global Privacy Control or similar browser-based opt-out preference signals where legally required and technically feasible. Because we do not sell or share personal information for cross-context behavioral advertising, such signals will be treated consistently with that practice.

California residents may also request information under California's "Shine the Light" law regarding certain disclosures of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes without consent.

14. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including HTTPS/SSL, access controls, secure hosting infrastructure, secure payment processing through PCI-compliant providers, and business practices intended to limit access to personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

15. International Users

The Services are operated from the United States. If you access the Services from outside the United States, your information may be transferred to, stored in, and processed in the United States. We do not currently intentionally target users in the European Union or United Kingdom, but occasional international users may access or purchase Services. If additional international legal obligations apply, we will update our notices and practices as appropriate.

16. Third-Party Websites and Platforms

The website or Services may link to third-party websites, platforms, or services. We are not responsible for the privacy practices, content, or terms of third-party websites or services. You should review their privacy policies and terms before using them.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted on the website with a new Last Updated date. If changes materially affect how we use personal information, we may provide additional notice by email, website notice, account notice, or another reasonable method where required by law.

18. Coach Referral and Attribution

If you arrive at the Services through a referral link from a Briggs Certified Coach, or if you use a coach-specific promotional code at checkout, we record an attribution between you and that coach for the duration of an attribution window (currently 30 days from your first visit via their referral link). During and after this window, the following disclosures apply:

  • The referring coach will be able to see that you visited their referral page and may see the date(s) on which you started or completed an assessment associated with their referral.
  • If you create an account or purchase a product associated with the referral, the referring coach will be able to see your name and email address in their partner portal in order to support the coaching relationship you have chosen with them.
  • The referring coach will not see your assessment responses, scores, results content, or any deliverables (such as your downloadable report) unless you explicitly choose to share them by selecting the "Share with my coach" option from your results page.
  • You may revoke a previously granted share at any time from your account settings, after which the coach will no longer have access to that shared content.
  • You may opt out of coach attribution entirely by purchasing without using a referral link or a coach promotional code.

We disclose this attribution to coaches in order to support the coaching relationship you have chosen with them and to enable the discount and tracking offered through the Briggs Certified Coach program. Coaches are bound by a written Coach Partner Agreement that includes obligations regarding the confidentiality and permitted use of your information.
